Whether you’re searching for compassionate care for someone you love or offering your caregiving services to families in your community, we’re honored you’ve chosen to be here.

UmahCare was created to make it easier for families and caregivers to connect in a trusted online marketplace. We believe meaningful care begins with meaningful relationships, and our goal is to provide a platform that helps make those connections possible.

These Terms of Service (“Terms”) explain how our Platform works, your rights and responsibilities as a user, and the rules that help keep our community safe, respectful, and trustworthy.

Please read these Terms carefully before creating an account or using our Platform.

By accessing, browsing, creating an account, purchasing a subscription, posting a listing, or otherwise using UmahCare, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any other policies incorporated by reference.

If you do not agree with these Terms, please do not use the Platform.


2. Definitions

For purposes of these Terms:

“Platform” means the UmahCare website, services, software, applications, marketplace, and related features.

“Family” means any individual seeking caregiving services through UmahCare.

“Caregiver” means an independent individual using UmahCare to advertise or offer caregiving services.

“User” means any person who accesses or uses the Platform.

“Subscription” means a paid membership that allows caregivers to create and maintain a caregiver profile and access subscription features.

“Content” includes photographs, biographies, listings, reviews (if implemented), certifications, messages, documents, background checks, videos, logos, text, and other information uploaded to the Platform.


3. About UmahCare

UmahCare is an online marketplace that connects families with independent caregivers.

The Platform allows:

  • Families to create accounts and post caregiving needs.
  • Caregivers to create professional profiles through a paid subscription.
  • Families to browse caregiver profiles.
  • Caregivers to apply for opportunities where applicable.
  • Users to communicate through features offered by the Platform.

UmahCare’s role is limited to providing technology that helps users connect.

We do not provide caregiving services.

We do not employ caregivers.

We do not supervise caregivers.

We do not direct caregiving services.

We do not guarantee employment.

We do not guarantee that any caregiver will be hired.

We do not guarantee that any family will hire a caregiver.

All decisions regarding hiring, employment, scheduling, compensation, supervision, and termination are made solely between the family and caregiver.


4. Eligibility

To use UmahCare, you must:

  • Be at least eighteen (18) years of age.
  • Have legal capacity to enter into a binding agreement.
  • Provide truthful and accurate information.
  • Comply with all applicable federal, state, and local laws.
  • Use the Platform only for lawful purposes.

By creating an account, you represent and warrant that you meet these eligibility requirements.


5. User Accounts

To access certain features, users must create an account.

You agree to:

  • Provide accurate information.
  • Keep your information updated.
  • Protect your password.
  • Maintain the confidentiality of your login credentials.
  • Notify UmahCare immediately of unauthorized access.

You are responsible for all activity occurring under your account.

UmahCare is not responsible for losses resulting from unauthorized use caused by failure to safeguard your credentials.


6. Family Accounts

Families may create an account to:

  • Search for caregivers.
  • Post care requests.
  • Communicate with caregivers through available Platform features.
  • Manage listings.

Families are responsible for ensuring all information they post is truthful, respectful, and lawful.


7. Caregiver Accounts

Caregivers may create professional profiles by purchasing an active subscription.

Caregivers are responsible for maintaining accurate and up-to-date information, including:

  • Experience
  • Services offered
  • Availability
  • Certifications
  • Licenses
  • Background checks
  • Profile photographs
  • Contact information

Misrepresenting qualifications, credentials, or experience is strictly prohibited.


8. Independent Contractor Relationship

Caregivers using UmahCare are independent professionals.

Nothing contained in these Terms creates an employer-employee relationship, agency relationship, partnership, joint venture, franchise, or similar relationship between UmahCare and any caregiver.

Caregivers are solely responsible for:

  • Their services
  • Their business practices
  • Their taxes
  • Insurance
  • Licensing
  • Compliance with applicable laws

Families are solely responsible for determining whether a caregiver meets their needs.


9. What UmahCare Does Not Guarantee

While we strive to provide a helpful and reliable marketplace, UmahCare does not guarantee:

  • Employment opportunities.
  • Caregiver availability.
  • Family inquiries.
  • Hiring decisions.
  • Service quality.
  • Compatibility between users.
  • Successful placements.
  • Accuracy of user-provided information.
  • Continuous Platform availability.

Users assume responsibility for their interactions and decisions.


10. Background Checks and Credentials

UmahCare may allow caregivers to upload background checks, certifications, CPR cards, licenses, or other supporting documentation.

Unless expressly stated otherwise:

  • UmahCare does not independently verify uploaded documents.
  • UmahCare does not conduct criminal background checks on behalf of caregivers.
  • UmahCare does not guarantee the authenticity, completeness, or accuracy of uploaded documents.
  • Families remain responsible for conducting their own due diligence before hiring any caregiver.

Families are encouraged to independently verify qualifications, references, certifications, licenses, and background information before entering into any caregiving arrangement.

11. Caregiver Responsibilities

Caregivers play an important role in building a trustworthy marketplace. By creating and maintaining a caregiver profile on UmahCare, you agree to conduct yourself in a professional, respectful, and lawful manner at all times.

As a caregiver, you agree to:

  • Provide truthful, accurate, and current information in your profile.
  • Maintain all certifications, licenses, registrations, and training required by applicable law for the services you offer.
  • Accurately represent your qualifications, experience, education, and skills.
  • Maintain a respectful and professional relationship with families and other users.
  • Communicate honestly and promptly regarding availability and services.
  • Perform services in accordance with all applicable laws and regulations.
  • Protect the privacy and confidentiality of families and those receiving care.
  • Maintain any insurance required by law or appropriate for your services.
  • Immediately update your profile if your qualifications, certifications, or availability change.

Caregivers are solely responsible for the services they provide, including the quality of care, scheduling, pricing, transportation, safety practices, taxes, insurance, and compliance with applicable laws.

Caregivers understand that their continued use of the Platform depends upon maintaining honest and accurate information. Any misrepresentation may result in suspension or permanent removal from the Platform.


12. Family Responsibilities

Families are responsible for making informed decisions when selecting caregivers.

By using UmahCare, families agree to:

  • Provide truthful information about their care needs.
  • Communicate respectfully with caregivers.
  • Conduct their own interviews before hiring.
  • Verify caregiver qualifications, certifications, references, and experience.
  • Determine whether a caregiver is appropriate for their family’s specific needs.
  • Comply with all applicable employment, tax, wage, and labor laws if they choose to hire a caregiver.
  • Maintain respectful communication throughout the hiring process.

Families understand that UmahCare does not supervise caregivers and cannot guarantee the quality, safety, suitability, or outcome of any caregiving relationship.


13. Subscription Services

Certain features of the Platform are available only through a paid caregiver subscription.

An active subscription allows caregivers to maintain a professional profile and access subscription-related features available through the Platform.

Subscription pricing, available features, and billing terms may be updated from time to time. Any changes will apply prospectively and will not affect charges already incurred.

By purchasing a subscription, caregivers authorize UmahCare and its payment processor to charge the applicable subscription fee according to the selected billing cycle. Additional information regarding subscription billing, cancellations, listing visibility, and refunds can be found in our Subscription & Cancellation Policy and Refund Policy, which are incorporated into these Terms by reference.


14. Billing and Payment

Subscription payments are securely processed through Stripe or another authorized third-party payment processor selected by UmahCare.

UmahCare does not store complete payment card information.

By submitting payment information, you represent and warrant that:

  • You are authorized to use the payment method provided.
  • The payment information is accurate and current.
  • You authorize recurring charges if you enroll in an automatically renewing subscription.

Failure to provide valid payment information may result in suspension or termination of subscription benefits.


15. Automatic Renewals

Unless otherwise stated at the time of purchase, caregiver subscriptions automatically renew at the end of each billing period.

By purchasing a subscription, you authorize UmahCare to charge your selected payment method for each renewal unless you cancel your subscription before the next billing cycle.

You are responsible for managing your subscription and ensuring your payment information remains current.


16. Failed Payments

If a payment cannot be successfully processed, UmahCare may:

  • Retry the payment.
  • Notify you of the failed transaction.
  • Suspend subscription benefits.
  • Remove your caregiver listing from public view.
  • Restrict access to subscription features until payment is successfully received.

Repeated failed payment attempts may result in permanent account suspension or termination.


17. Subscription Cancellation

Caregivers may cancel their subscription at any time through their account settings or by following the cancellation process provided on the Platform.

Unless otherwise required by law or specifically stated in a separate written agreement:

  • Cancellation stops future recurring billing.
  • Cancellation does not automatically create a refund.
  • Subscription benefits end according to the terms described in the Subscription & Cancellation Policy.

UmahCare reserves the right to update subscription terms with reasonable notice.


18. Listing Visibility Following Cancellation

Caregiver profiles that require an active subscription may no longer remain publicly visible following cancellation or expiration of the subscription. Due to the current functionality of the Platform, cancellation may result in the immediate loss of access to subscription features. Removal of a listing following cancellation does not constitute deletion of the caregiver’s account. Users may reactivate their account by purchasing a new eligible subscription, subject to the Platform’s current terms and pricing.


19. Refunds

Subscription purchases are governed by the UmahCare Refund Policy. Unless otherwise required by applicable law or expressly stated in writing by UmahCare, subscription fees are non-refundable. Submitting a cancellation request does not automatically entitle a user to a refund. UmahCare may, at its sole discretion, review refund requests on a case-by-case basis.


20. User Content

Users may upload content including, but not limited to:

  • Profile information
  • Listings
  • Photographs
  • Certifications
  • Background checks
  • Documents
  • Messages
  • Other materials made available through the Platform

You retain ownership of the content you submit.

However, by uploading content to the Platform, you grant UmahCare a non-exclusive, worldwide, royalty-free, transferable license to host, reproduce, display, distribute, modify solely as necessary for formatting or technical purposes, and use your content for the purpose of operating, maintaining, improving, and promoting the Platform.

You represent and warrant that:

  • You own or have permission to use all uploaded content.
  • Your content does not violate the rights of any third party.
  • Your content does not infringe any copyright, trademark, privacy, publicity, or intellectual property rights.

UmahCare reserves the right to remove any content that violates these Terms or is otherwise deemed inappropriate, misleading, unlawful, or harmful to the Platform or its users.


21. Intellectual Property

All content created and owned by UmahCare, including but not limited to the UmahCare name, logo, branding, website design, software, graphics, text, layout, and other proprietary materials, is protected by applicable intellectual property laws.

Except as expressly permitted in writing, users may not:

  • Copy, reproduce, distribute, modify, or create derivative works from UmahCare content.
  • Reverse engineer or attempt to extract source code from the Platform.
  • Use UmahCare trademarks or branding without prior written permission.

Unauthorized use may result in legal action.


22. Acceptable Use

To help maintain a safe and respectful marketplace, users agree not to:

  • Provide false or misleading information.
  • Upload fraudulent or altered documents.
  • Misrepresent their identity or qualifications.
  • Harass, threaten, intimidate, or abuse other users.
  • Discriminate against any person based on protected characteristics under applicable law.
  • Upload viruses, malware, or harmful code.
  • Attempt unauthorized access to the Platform or other user accounts.
  • Interfere with the operation or security of the Platform.
  • Use automated software, bots, or scraping tools without written permission.
  • Collect or misuse another user’s personal information.
  • Violate any applicable federal, state, or local law.

Violation of these rules may result in immediate suspension or permanent termination of your account.


23. Suspension and Termination

UmahCare reserves the right, in its sole discretion and without prior notice where appropriate, to suspend, restrict, or terminate any account that:

  • Violates these Terms.
  • Engages in fraudulent, deceptive, or unlawful conduct.
  • Creates safety concerns for other users.
  • Repeatedly receives credible complaints of misconduct.
  • Fails to maintain accurate account information.
  • Misuses the Platform or its services.

UmahCare may also remove listings or restrict access to specific features while investigating potential violations.

Termination of an account does not release a user from obligations incurred before termination, including outstanding payment obligations or legal responsibilities.

UmahCare Subscription & Cancellation Policy

Our caregiver subscription allows independent caregivers to create and maintain a professional profile, showcase their experience, and connect with families seeking care through the UmahCare marketplace.

By purchasing a subscription, you agree to this Subscription & Cancellation Policy as well as our Terms of Service and Refund Policy.


2. Subscription Benefits

An active caregiver subscription may include access to features such as:

  • Creating and maintaining a caregiver profile
  • Displaying your profile in the caregiver directory
  • Applying for family care opportunities (where available)
  • Uploading supporting documents, such as certifications and background checks
  • Managing your caregiver listing through your account dashboard

Available features may change from time to time as UmahCare continues to improve the Platform.


3. Subscription Fees

Subscription pricing is displayed at the time of purchase.

All fees are listed in U.S. Dollars (USD) unless otherwise stated.

By purchasing a subscription, you authorize UmahCare’s third-party payment processor to charge your selected payment method.


4. Automatic Renewal

Unless otherwise stated during checkout, subscriptions automatically renew at the end of each billing period using the payment method on file.

If you do not wish to renew your subscription, you must cancel before your next renewal date.


5. Cancellation

You may cancel your subscription at any time through your account or by following the cancellation instructions provided on the Platform.

Cancelling your subscription stops future recurring charges but does not automatically entitle you to a refund.


6. Listing Visibility After Cancellation

Because an active subscription is required to maintain a caregiver listing, cancelling your subscription may result in your caregiver profile and listing being removed from public view.

Your account may remain active, allowing you to reactivate your subscription at a later date, unless your account has been otherwise suspended or terminated under our Terms of Service.


7. Failed Payments

If a subscription payment cannot be processed, UmahCare may:

  • Retry the payment.
  • Notify you of the failed payment.
  • Suspend subscription benefits.
  • Remove your caregiver listing from public view until payment is successfully received.

8. Changes to Subscription Pricing

UmahCare reserves the right to modify subscription pricing at any time.

Any pricing changes will apply prospectively and will not affect subscription fees already paid for the current billing period.

Users will be provided with reasonable notice of pricing changes before they take effect.

2. Subscription Fees

Subscription fees provide caregivers with access to features available through an active subscription, including maintaining a caregiver profile and accessing subscription-related services offered through the Platform.

Subscription fees are charged according to the pricing displayed at the time of purchase.


3. Refund Eligibility

Unless otherwise required by applicable law, subscription fees are generally non-refundable once payment has been successfully processed.

However, UmahCare may, at its sole discretion, consider refunds in limited circumstances, including:

  • Duplicate charges resulting from a billing error.
  • An incorrect charge caused by a technical issue on our Platform.
  • Other exceptional circumstances reviewed on a case-by-case basis.

Submitting a refund request does not guarantee that a refund will be issued.


4. Subscription Cancellations

Cancelling your subscription prevents future recurring charges but does not automatically entitle you to a refund for the current billing period.

5. Chargebacks

If you believe your payment was made in error, we encourage you to contact us before initiating a chargeback with your financial institution.

UmahCare reserves the right to modify this Refund Policy at any time. Any changes will become effective upon posting the updated policy on our website.
